Terms of Use

These Terms of Use (the "Terms" or "EULA") form a binding agreement between you ("you," "your") and Make Me ("Make Me," "we," "us," "our") and govern your use of the Make Me iOS application, the website at trymakeme.app, and any related services (collectively, the "Service"). By installing or using the Service, you agree to these Terms. If you do not agree, do not install or use the Service.

1. The Service

Make Me is an iPhone application that converts physical activity (pushups, squats, walking) into time-based access for apps you choose to restrict. The Service is provided "as-is" and may evolve over time. We may add, modify, or remove features and will use reasonable efforts to communicate substantive changes in the app.

2. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Service on iOS devices that you own or control, solely for your personal, non-commercial use, and as permitted by the App Store Terms of Service.

3. Eligibility & account

You must be at least 13 years old to use the Service (or such higher age as required in your jurisdiction). Users under 18 represent that a parent or guardian has reviewed and agreed to these Terms on their behalf. The Service does not require an Make Me account; access is tied to your iOS device and Apple ID.

4. Subscriptions, billing, and auto-renewal

Make Me offers an optional subscription. Subscriptions are sold and billed by Apple through your Apple ID. All current terms — duration, content, charge amount, and any introductory offer — are shown at point of purchase in the App Store and on the in-app paywall.

Auto-renewal disclosure

By subscribing, you authorize Apple to charge your Apple ID for the subscription. Subscriptions automatically renew at the end of each subscription period unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. If an introductory offer is provided, unless you cancel at least 24 hours before it ends, it converts automatically to a paid subscription on the terms shown at signup. You can manage your subscriptions and turn off auto-renewal in your Apple ID account settings (Settings → Apple ID → Subscriptions) after purchase.

5. Cancellation & refunds

You can cancel your subscription at any time in Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period; your subscription access continues until then. We do not process payments and cannot directly refund a charge — refund requests must be made through reportaproblem.apple.com, subject to Apple's refund policy.

6. Your responsibilities

  • Use the Service for lawful purposes and in compliance with these Terms.
  • Do not use Make Me to restrict another person's device without their knowledge and informed consent.
  • Do not attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source of the Service, except to the extent that such restriction is prohibited by law.
  • Do not interfere with the operation of the Service or attempt to circumvent the shielding, balance, or rep-counting mechanisms.
  • Maintain the security of your iOS device and Apple ID.

7. Health & safety disclaimer

Make Me is not a medical device, fitness coach, or therapeutic product. Rep counting is a behavioral pricing mechanism, not training advice. Consult a qualified professional before starting any exercise program. Stop immediately if you feel pain, dizziness, or discomfort. You are solely responsible for your physical safety while using the Service. We disclaim any liability for injury or harm resulting from exercise performed in connection with the Service.

8. Prohibited conduct

You may not (and may not permit anyone else to):

  • Use the Service to violate any law, regulation, or third-party right.
  • Use automated means (bots, scripts) to inflate rep counts or earned minutes.
  • Resell, sublicense, or commercially exploit the Service.
  • Remove or alter any proprietary notices in the app.
  • Use the Service in any way that could harm minors.
  • Probe, scan, or test the vulnerability of the Service or any related infrastructure without our prior written consent.

9. Intellectual property

The Service, including all software, designs, text, graphics, marks, and other content, is owned by Make Me and its licensors and is protected by copyright, trademark, and other laws. Apart from the license in §2, no rights are granted to you. "Make Me" and the diamond mark are trademarks of Make Me. Other marks belong to their respective owners.

10. Third-party services & Apple

The Service relies on third-party platforms — Apple's iOS, App Store, Family Controls, HealthKit, StoreKit, iCloud, and CloudKit — and on RevenueCat for subscription state. We are not responsible for the operation, availability, or terms of any third-party platform.

Apple-required EULA terms (App Store). You acknowledge that:

  • These Terms are between you and Make Me only, and not with Apple Inc. ("Apple"). Apple is not responsible for the Service or its content.
  • Apple has no obligation to provide maintenance or support for the Service.
  • If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Service. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service.
  • Make Me, not Apple, is responsible for addressing any claims by you or any third party relating to the Service or your possession or use of it, including product liability, failure to comply with legal or regulatory requirements, consumer protection claims, and intellectual property infringement claims.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKEME DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACHIEVE ANY SPECIFIC OUTCOME (INCLUDING REDUCED PHONE USE OR IMPROVED FITNESS).

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKEME AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (b) USD $50.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify, defend, and hold harmless Make Me and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) your use of the Service, (b) your breach of these Terms, or (c) your violation of any applicable law or third-party right.

14. Termination

You may stop using the Service at any time by deleting the app. We may suspend or terminate your access to the Service if you breach these Terms or if continued provision becomes commercially impracticable. Sections that by their nature should survive termination (including §§ 10, 12, 13, 14, 16) will survive.

15. Governing law & disputes

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any consumer rights you may have under mandatory law in your country of residence.

16. Changes

We may update these Terms from time to time. If a change is material, we will update the "Effective" date and surface a notice in the app on the next launch. Continued use of the Service after a change indicates acceptance of the revised Terms.
